Terms and Conditions of Using TopSend

Please read these terms and conditions carefully. By using the TopSend website or application, you agree to use the services in accordance with these rules. If you do not agree with any part of these terms, please do not use our services.

1. Introduction

  • TopSend is a product of Maknak L.L.C-FZ; a registered and officially licensed company in the United Arab Emirates (License No: 2534073.01).
  • TopSend services are designed for Afghans living abroad so they can send mobile credit, internet packages, and gift cards to their family and friends in Afghanistan from anywhere in the world.
  • We work with all major Afghan operators: Roshan, Etisalat, MTN, Salaam, Afghan Wireless, and Afghan Telecom.

Maknak was established in Dubai in 2025 and has been actively operating in the digital services field since 2022.

3. Registration and User Account

  • To use certain features, you may need to create a user account. During registration, you must enter accurate and correct information (name, email, phone number, and payment details).
  • You are responsible for maintaining the security of your password, and all activities conducted through your account are your responsibility.
  • User accounts are personal and non-transferable.
  • Users under 16 years of age must use the services with parental consent.

4. How to Use Services

  • You agree to use TopSend only for lawful purposes and in accordance with these terms.
  • Any use of services for illegal, fraudulent, or harmful activities is prohibited.
  • TopSend services are only provided for sending credit, internet packages, and gift cards to Afghanistan.

5. Payments and Fees

  • Payments are made through reputable international methods such as Visa, MasterCard, American Express, PayPal, Apple Pay, and Google Pay (cryptocurrency payments are not supported).
  • Before finalizing a transaction, all amounts and fees are displayed transparently.
  • If there is a currency difference, the exchange rate is calculated at the time of payment.
  • Due to the instant nature of services, refunds are not possible after successful delivery of credit or gift cards. Please verify the recipient's number carefully.

6. Delivery and Confirmation

  • After successful payment, your order is immediately sent to the relevant operator in Afghanistan.
  • In most cases, the credit is delivered within seconds, but in some cases it may take a few minutes.
  • A confirmation message will be sent to you via email or SMS.

7. Promotional Plans and Loyalty Points

  • TopSend may occasionally run campaigns, discounts, or loyalty programs.
  • Details and conditions of each plan are clearly announced in the application.
  • Unauthorized use or abuse of discount codes may result in account suspension.

8. User Responsibilities

  • The user is obligated to enter all information correctly.
  • TopSend and Maknak are not responsible for damages caused by user errors (such as entering an incorrect number).
  • The user must also ensure the security of their device and internet connection.

9. Intellectual Property Rights

  • All intellectual property rights related to the name, trademark, design, and content of TopSend belong to Maknak L.L.C-FZ.
  • Any use, copying, or modification without written permission from the company is prohibited.

10. Privacy and Data

  • Users' personal information is collected and protected in accordance with TopSend's privacy policy.
  • By using our services, you consent to your data being used for transaction processing and legal compliance.

11. Limitation of Liability

  • To the extent permitted by law, Maknak and its subsidiaries are not liable for indirect or consequential damages (such as loss of data or profits).
  • In any case, the company's liability shall not exceed the amount of the same transaction.

12. Suspension or Termination of Services

  • In case of rule violations, suspicious behavior, or misuse, we may suspend or cancel the user's account without prior notice.
  • The user may also close their account at any time by submitting a written request.

13. Force Majeure

In circumstances such as war, natural disasters, network disruptions, or government decisions beyond our control, Maknak shall not be responsible for delays or temporary service interruptions.

14. Changes to Terms

  • These terms may change from time to time for legal or technical reasons.
  • The new version is always published on the website and application, and continued use of services constitutes acceptance of changes.

15. Governing Law and Jurisdiction

These terms are governed by the laws of the United Arab Emirates, and any disputes shall be subject to the jurisdiction of the courts of Dubai.
